Preamble and Purpose<\/h3><p>These General Terms and Conditions of Sale (GTCS) govern all relations between :<\/p><ul><li><b>Massard-Guersan &amp; Cie SNC\u00a0<\/b>(hereinafter referred to as the \"Seller\") and<\/li><li>Any person (hereinafter referred to as the \"Customer\" or \"You\") who orders a holiday or a trip on the website <a href=\"http:\/\/www.breeziful.fr\" target=\"_new\" rel=\"noreferrer\">www.breeziful.fr<\/a>.<\/li><\/ul><p>The Customer acknowledges that he\/she has read the GTC and accepts them by clicking on the \"Confirm and pay for my order\" button.<\/p><h3>\u00a0<\/h3><h3>2. Capacity<\/h3><p>The Customer declares that he\/she has the legal capacity to contract under the conditions described in these GTC, i.e. that he\/she is of legal age and not under guardianship or curatorship.<\/p><h3>\u00a0<\/h3><h3>3. No retraction<\/h3><p>In accordance with the applicable legislation, the customer does not have a right of withdrawal once the order has been validated, given the nature of the services offered, which comprise services for a specific date or period and do not constitute a package.<\/p><p>\u00a0<\/p><h3>4. Duration of journey<\/h3><p>The length of stay is calculated in <strong>nights<\/strong>If the customer arrives late or leaves early, the charge will be calculated from the scheduled arrival date to the departure date, regardless of the customer's arrival or departure time. If, for example, the customer arrives late or leaves early, the <strong>whole night is counted<\/strong> and no refunds or reductions will be applied for unused periods. This includes any first or last night partially used due to arrival or departure times.<\/p><h3>\u00a0<\/h3><h3>5. Booking and payment<\/h3><h4>5.1. Application fee and deposit<\/h4><ul><li>There is no administration fee.<\/li><li>For all bookings made more than 30 days before departure, a deposit of 50% of the total price of the trip excluding transport is required.<\/li><li>For special offers or promotions, 100% of the amount is required at the time of booking.<\/li><\/ul><h4>5.2. Payment of the balance<\/h4><p>The balance must be paid no later than 30 days before departure. In the event of non-payment, the booking will be considered cancelled with no right to reimbursement of the deposit.<\/p><h4>5.3. Booking confirmation<\/h4><p>Reservations will be definitively confirmed by\u00a0<span style=\"font-weight: bold;\">Massard-Guersan &amp; Cie SNC\u00a0<\/span>after 72 hours, the time required to check the availability of the products reserved. In the event of non-availability, the total amount will be refunded. No changes or cancellations are possible during this 72-hour period. In the event of non-availability, the total amount will be refunded.<\/p><h3>\u00a0<\/h3><h3>6. Awards<\/h3><p>The prices shown include the services specified. Unless otherwise indicated, they do not include insurance, formalities, drinks, tips, transfers or personal expenses. Additional local taxes must be paid locally.<\/p><h5>6.1. Means of payment<\/h5><p>Reservations can be paid by :<\/p><ul><li>Credit card (Carte Bleue, Mastercard, Visa, American Express)<\/li><li>PayPal<\/li><\/ul><h3>\u00a0<\/h3><h3>7. Cancellation and amendment<\/h3><h4>7.1. Cancellation by the Customer<\/h4><p>Cancellations must be notified by registered letter with acknowledgement of receipt or by e-mail. Cancellation charges are :<\/p><ul><li>More than 30 days before departure: 30% of the total amount.<\/li><li>Less than 30 days before departure: 100% of the total amount.<\/li><li>For promotions or special offers: 100% of the total amount, regardless of the cancellation date.<\/li><\/ul><h4>7.2. Modification by the organiser<\/h4><p>Prices, timetables and itineraries may be modified by third party service providers for reasons beyond the control of Massard-Guersan &amp; Cie SNC. The customer will be informed as soon as possible and may accept the modification or obtain a refund.<\/p><h3>\u00a0<\/h3><h3>8. Assignment of contract<\/h3><p>Customers may transfer their contract to a third party meeting the same conditions, no later than 7 days before departure, by informing\u00a0<span style=\"font-weight: bold;\">Massard-Guersan &amp; Cie SNC<\/span>. The transferor and the beneficiary are jointly and severally liable for payment of the balance and the transfer costs.<\/p><h3>\u00a0<\/h3><h3>9. Formalities<\/h3><p>The Customer must ensure that his\/her travel documents (passport, visa, etc.) comply with the requirements of the destination and transit countries.\u00a0<span style=\"font-weight: bold;\">Massard-Guersan &amp; Cie SNC\u00a0<\/span>shall not be held liable in the event of failure to comply with these obligations.<\/p><h3>\u00a0<\/h3><h3>10. Transport<\/h3><p><span style=\"font-weight: bold; text-align: var(--text-align);\">Massard-Guersan &amp; Cie SNC\u00a0<\/span>does not sell any means of transport, unless otherwise stated. The Client must check the dates, times and conditions of transport. Breeziful will not be held responsible for any problems related to transport.<\/p><h3>\u00a0<\/h3><h3>11. Accommodation and stay<\/h3><h4>11.1. Home<\/h4><p>Customers are expected between 12:00 and 20:00, unless otherwise stated. In the event of a delay, they must inform reception. Tourist tax is payable on site.<\/p><h4>11.2 Security deposit<\/h4><p>A security deposit may be required on arrival, which will be returned after your stay, less any damage costs.<\/p><h4>11.3 Theft and loss<\/h4><p>The Client must insure himself against the risks of theft, loss or damage of his personal belongings. Breeziful cannot be held responsible for lost or stolen items.<\/p><h3>\u00a0<\/h3><h3>12. Insurance<\/h3><p>No insurance is included. The Customer is invited to take out additional insurance to cover the risks associated with the trip.<\/p><h3>\u00a0<\/h3><h3>13. Claims, disputes and liability<\/h3><p>The services of <strong>Massard-Guersan &amp; Cie SNC<\/strong> acts as an intermediary between customers and tourism service providers, such as hotels, transport companies and activity organisers. However, certain services may be offered for resale by Massard-Guersan &amp; Cie SNC as a result of a <strong>exchange of goods<\/strong>. As such, the following conditions apply in the event of claims, disputes or questions of liability.<\/p><ol><li><p><strong>Nature of services resold<br \/><\/strong>Certain services offered by <strong>Massard-Guersan &amp; Cie SNC<\/strong> are the result of a <strong>exchange of goods<\/strong> with third-party service providers. This means that <strong>Massard-Guersan &amp; Cie SNC<\/strong> offered communication services to service providers who, in return, provided tourist services (accommodation, activities, etc.) in lieu of cash payment.<br \/><strong>Massard-Guersan &amp; Cie SNC<\/strong> then resells these services to end customers as part of its own commercial activity.<\/p><\/li><li><p><strong>Collection and liability<br \/><\/strong><strong>Massard-Guersan &amp; Cie SNC<\/strong> collects payments directly from customers for services resold. It is important to note that, although <strong>Massard-Guersan &amp; Cie SNC<\/strong> be the entity invoicing the customer, the company's main role remains that of a \"service provider\". <strong>buyer<\/strong> and <strong>service reseller<\/strong>The services sold are provided by third parties.<\/p>Consequently, the responsibility of <strong>Massard-Guersan &amp; Cie SNC<\/strong> is limited to contractual obligations relating to the resale of the service and the administrative management of payment. <strong>Massard-Guersan &amp; Cie SNC<\/strong> cannot be held responsible for defects in the performance of services by third-party providers, as the actual performance of the services remains the responsibility of the provider.<br \/><br \/><\/li><li><p><strong>Claims relating to benefits<br \/><\/strong>Complaints concerning the performance of services must be addressed directly to <strong>service providers<\/strong> concerned. <strong>Massard-Guersan &amp; Cie SNC<\/strong> will endeavour to facilitate communication between the customer and the third party provider to resolve any issues, but does not guarantee resolution of the claim.<br \/><br \/>Customers should be aware that the services sold by <strong>Massard-Guersan &amp; Cie SNC<\/strong> were obtained as a result of an exchange of goods, and only as a reseller, <strong>Massard-Guersan &amp; Cie SNC<\/strong> cannot assume the operational responsibilities of the service provider.<\/p><\/li><li><p><strong>Limitation of liability<br \/><\/strong><strong>Massard-Guersan &amp; Cie SNC<\/strong> declines all responsibility for <strong>consequential damages<\/strong> resulting from the provision of services by third parties, including, but not limited to, loss of holiday enjoyment, moral prejudice or any other indirect loss.<br \/><br \/>In the event of a booking error due to incorrect information provided by the customer, <strong>Massard-Guersan &amp; Cie SNC<\/strong> cannot be held responsible. It is the customer's responsibility to provide accurate and complete information at the time of booking.<\/p><\/li><li><p><strong>Litigation<br \/><\/strong>In the event of <strong>litigation<\/strong> relating to the provision of services supplied by a third-party service provider, the dispute must be settled in accordance with the legislation of the country in question. <strong>provider's country<\/strong> concerned. <strong>Massard-Guersan &amp; Cie SNC<\/strong> will facilitate communication between the parties, but will not intervene in the legal settlement of disputes.<br \/><br \/>If the dispute directly concerns a resale service (for example, an administrative processing error), it will be submitted to the competent court in <strong>location of registered office<\/strong> from <strong>Massard-Guersan &amp; Cie SNC<\/strong>in accordance with <strong>Swiss law<\/strong>.<\/p><\/li><li><p><strong>Force Majeure<br \/><\/strong>Massard-Guersan &amp; Cie SNC cannot be held responsible for the non-performance or improper performance of contractual obligations in the event of <strong>force majeure<\/strong>as defined by law, including in particular events such as natural disasters, armed conflicts, epidemics or any other unforeseeable circumstance beyond its control. <strong>Massard-Guersan &amp; Cie SNC<\/strong> will try to inform the customer as soon as possible and the obligations will be suspended without this giving rise to any right to compensation.<\/p><br \/>By using the services of <strong>Massard-Guersan &amp; Cie SNC<\/strong>The customer acknowledges acceptance of the general conditions set out above and understands the division of responsibilities between Massard-Guersan &amp; Cie SNC and third party service providers.<br \/><br \/><\/li><\/ol><h3>14. Applicable law<\/h3><p>The sales contract is governed by Swiss law. Any dispute will be brought before the competent courts.<\/p><hr \/><p>These general terms and conditions of sale may be amended at any time by\u00a0<span style=\"font-weight: bold;\">Massard-Guersan &amp; Cie SNC<\/span>. The Customer is invited to consult the GTC regularly on the site. Services provided:<\/h3><p><span style=\"text-align: var(--text-align); font-weight: bold;\">Massard-Guersan &amp; Cie SNC<\/span><span style=\"text-align: var(--text-align);\">.\u00a0<\/span>offers a range of tourism services, including<\/p><ul><li>La <strong>accommodation bookings<\/strong> such as hotels, holiday homes or self-catering accommodation.<\/li><li>L'<strong>organisation of excursions<\/strong> and tourist activities, such as guided tours, transfers and cultural outings.<\/li><li>La <strong>linking<\/strong> with local service providers for various tourist services.<\/li><\/ul><p>These services are provided individually and independently of each other. It is important to stress that these services <strong>do not constitute a package holiday<\/strong> within the meaning of the applicable legislation, i.e. a combination of several travel services sold together for an overall price and covering a significant period of time. Consequently, the legal protections applicable to package holidays do not apply to our services.<\/p><p>Our services are designed to offer total flexibility, allowing our customers to personalise every aspect of their experience, but each service is reserved for a specific purpose. <strong>separate<\/strong> and does not involve any combination that is legally considered a 'package'.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>","protected":false},"excerpt":{"rendered":"<p>1.
