1. Preamble and Purpose

These General Terms and Conditions of Sale (GTCS) govern all relations between :

  • Massard-Guersan & Cie SNC (hereinafter referred to as the "Seller") and
  • Any person (hereinafter referred to as the "Customer" or "You") who orders a holiday or a trip on the website www.breeziful.fr.

The Customer acknowledges that he/she has read the GTC and accepts them by clicking on the "Confirm and pay for my order" button.

 

2. Capacity

The Customer declares that he/she has the legal capacity to contract under the conditions described in these GTC, i.e. that he/she is of legal age and not under guardianship or curatorship.

 

3. No retraction

In accordance with the applicable legislation, the customer does not have a right of withdrawal once the order has been validated, given the nature of the services offered, which comprise services for a specific date or period and do not constitute a package.

 

4. Duration of journey

The length of stay is calculated in nightsIf the customer arrives late or leaves early, the charge will be calculated from the scheduled arrival date to the departure date, regardless of the customer's arrival or departure time. If, for example, the customer arrives late or leaves early, the whole night is counted and no refunds or reductions will be applied for unused periods. This includes any first or last night partially used due to arrival or departure times.

 

5. Booking and payment

5.1. Application fee and deposit

  • There is no administration fee.
  • For all bookings made more than 30 days before departure, a deposit of 50% of the total price of the trip excluding transport is required.
  • For special offers or promotions, 100% of the amount is required at the time of booking.

5.2. Payment of the balance

The balance must be paid no later than 30 days before departure. In the event of non-payment, the booking will be considered cancelled with no right to reimbursement of the deposit.

5.3. Booking confirmation

Reservations will be definitively confirmed by Massard-Guersan & Cie SNC after 72 hours, the time required to check the availability of the products reserved. In the event of non-availability, the total amount will be refunded. No changes or cancellations are possible during this 72-hour period. In the event of non-availability, the total amount will be refunded.

 

6. Awards

The prices shown include the services specified. Unless otherwise indicated, they do not include insurance, formalities, drinks, tips, transfers or personal expenses. Additional local taxes must be paid locally.

6.1. Means of payment

Reservations can be paid by :

  • Credit card (Carte Bleue, Mastercard, Visa, American Express)
  • PayPal

 

7. Cancellation and amendment

7.1. Cancellation by the Customer

Cancellations must be notified by registered letter with acknowledgement of receipt or by e-mail. Cancellation charges are :

  • More than 30 days before departure: 30% of the total amount.
  • Less than 30 days before departure: 100% of the total amount.
  • For promotions or special offers: 100% of the total amount, regardless of the cancellation date.

7.2. Modification by the organiser

Prices, timetables and itineraries may be modified by third party service providers for reasons beyond the control of Massard-Guersan & Cie SNC. The customer will be informed as soon as possible and may accept the modification or obtain a refund.

 

8. Assignment of contract

Customers may transfer their contract to a third party meeting the same conditions, no later than 7 days before departure, by informing Massard-Guersan & Cie SNC. The transferor and the beneficiary are jointly and severally liable for payment of the balance and the transfer costs.

 

9. Formalities

The Customer must ensure that his/her travel documents (passport, visa, etc.) comply with the requirements of the destination and transit countries. Massard-Guersan & Cie SNC shall not be held liable in the event of failure to comply with these obligations.

 

10. Transport

Massard-Guersan & Cie SNC does not sell any means of transport, unless otherwise stated. The Client must check the dates, times and conditions of transport. Breeziful will not be held responsible for any problems related to transport.

 

11. Accommodation and stay

11.1. Home

Customers are expected between 12:00 and 20:00, unless otherwise stated. In the event of a delay, they must inform reception. Tourist tax is payable on site.

11.2 Security deposit

A security deposit may be required on arrival, which will be returned after your stay, less any damage costs.

11.3 Theft and loss

The Client must insure himself against the risks of theft, loss or damage of his personal belongings. Breeziful cannot be held responsible for lost or stolen items.

 

12. Insurance

No insurance is included. The Customer is invited to take out additional insurance to cover the risks associated with the trip.

 

13. Claims, disputes and liability

The services of Massard-Guersan & Cie SNC acts as an intermediary between customers and tourism service providers, such as hotels, transport companies and activity organisers. However, certain services may be offered for resale by Massard-Guersan & Cie SNC as a result of a exchange of goods. As such, the following conditions apply in the event of claims, disputes or questions of liability.

  1. Nature of services resold
    Certain services offered by Massard-Guersan & Cie SNC are the result of a exchange of goods with third-party service providers. This means that Massard-Guersan & Cie SNC offered communication services to service providers who, in return, provided tourist services (accommodation, activities, etc.) in lieu of cash payment.

    Customers should be aware that the services sold by Massard-Guersan & Cie SNC were obtained as a result of an exchange of goods, and only as a reseller, Massard-Guersan & Cie SNC cannot assume the operational responsibilities of the service provider.

  4. Limitation of liability
    Massard-Guersan & Cie SNC declines all responsibility for consequential damages resulting from the provision of services by third parties, including, but not limited to, loss of holiday enjoyment, moral prejudice or any other indirect loss.

    In the event of a booking error due to incorrect information provided by the customer, Massard-Guersan & Cie SNC cannot be held responsible. It is the customer's responsibility to provide accurate and complete information at the time of booking.

  5. Litigation
    In the event of litigation relating to the provision of services supplied by a third-party service provider, the dispute must be settled in accordance with the legislation of the country in question. provider's country concerned. 14. Applicable law

15. Services provided:

Massard-Guersan & Cie SNCoffers a range of tourism services, including

These services are provided individually and independently of each other.
