Terms and Conditions of Sale

Terms applicable to orders for tourism services offered on Breeziful.

1. Seller's identity and scope

These General Terms and Conditions of Sale, hereinafter the "Terms", govern orders for services offered on the Breeziful website.

In these Terms, the expressions "Breeziful", "the Seller", "we", "our" or "us" refer to Massard-Guersan & Cie SNC. The expressions "Customer", "you" or "your" refer to any person who views an offer or places an order on Breeziful.

These Terms apply to tourism services offered for sale by Breeziful, including:

  • accommodation;
  • an activity or excursion;
  • a transfer;
  • a tourism experience;
  • a travel service sold separately;
  • another service clearly described on its presentation page.

The features specific to each service appear on its presentation page and in the order summary.

2. Acceptance of the terms

Before completing an order, the Customer must be able to view these Terms, save or print them, review the service's features, check the price and any charges, correct input errors and confirm acceptance of the applicable terms.

Confirmation of the order together with acceptance of the Terms expresses the Customer's agreement. The applicable version is the one presented to and accepted by the Customer when placing the order. The specific terms displayed on the offer page or in the order summary supplement these Terms; in the event of a conflict, a specific term expressly presented and accepted takes precedence for the service concerned, subject to mandatory statutory provisions.

3. Customer's legal capacity

The Customer declares that they have the legal capacity required to enter into the contract and must, in principle, be at least 18 years old. When an order is placed for several travellers, the Customer declares that they are authorised to provide their information and accept the terms required for their booking. The Customer is responsible for the accuracy of the information provided for themselves and the other beneficiaries of the order.

4. Nature of the services and Breeziful's role

Depending on the offer concerned, Breeziful may act as the seller or reseller of the service, an intermediary facilitating contact with a service provider, or a distributor of a service performed by a tourism partner. The applicable role must be stated in the offer presentation, order summary or order confirmation.

Operational delivery may be provided by a hotel, an accommodation provider, a destination management company, an activity organiser, a carrier, a guide or a local service provider. Some services may have been obtained through a commercial partnership or an exchange of services; this method of acquisition does not reduce the Customer's rights under the contract entered into and the applicable statutory provisions.

5. Individual services and package travel

These Terms are primarily intended for services sold individually. The mere fact that a service relates to tourism does not automatically mean that it constitutes package travel. Where an offer meets the criteria for package travel or falls under another mandatory legal regime, the corresponding mandatory provisions apply and take precedence over any incompatible clause in these Terms.

6. Information before ordering

Before an order is placed, Breeziful presents, where applicable:

  • the nature of the service, the destination, the dates or period and the duration;
  • the number of people included and the services included and excluded;
  • the identity or category of the service provider and the specific terms;
  • the price, any taxes or expenses payable locally, and the payment and cancellation terms;
  • the main conditions of use.

The Customer must read this information carefully and report any inconsistency before confirming the order.

7. Ordering process

The Customer selects the desired service, enters the requested information and accesses a summary. Before submitting the order, they must be able to check and correct the information entered. The final button must clearly indicate that confirmation entails an obligation to pay when an amount is due.

After submitting the order, the Customer receives an electronic acknowledgement of receipt. This acknowledgement does not confirm availability. The booking remains pending supplier confirmation under the conditions described below.

8. Availability and confirmation

Payment is made when the order is placed. Availability remains subject to confirmation by the supplier or service provider within 72 hours. The booking becomes final only after this confirmation. Neither receipt of payment nor the expiry of this period constitutes confirmation of availability.

If the service is unavailable or confirmation is not received within this period, the case is referred to a Breeziful administrator for review. An alternative may be offered to the Customer, who remains free to accept or refuse it. If a refund is necessary, only an administrator may explicitly initiate it. No refund is automatic. The refund is processed using the payment method used, within a reasonable period, without prejudice to the Customer's applicable rights.

9. Prices

The applicable price is the one displayed in the summary when the order is placed. The total price must include the mandatory items known to and charged by Breeziful. Local taxes payable on site, options, insurance, supplements, personal expenses, charges imposed directly by a service provider and services not covered by the offer are stated separately when they are not included. Prices, inclusions and exclusions may differ between offers.

10. Payment

The available payment methods are those displayed during checkout. Payment is processed using the secure solutions actually configured on the website. Breeziful does not directly store full payment card details when they are processed by the payment service provider.

10.1 Payment when ordering

The Customer pays the full amount displayed in the summary when submitting their request or order, regardless of the departure date. The current process does not offer payment by deposit. Collection of payment does not guarantee availability; the case remains pending supplier confirmation.

10.2 Failure to pay

If an amount is not paid when due, Breeziful may send a reminder and set a reasonable additional payment period. If payment is not brought up to date, the order may be cancelled. Any amounts retained may not exceed the applicable cancellation charges and the amounts permitted by law.

11. Duration, arrival and departure

For accommodation, the duration is generally calculated in nights between the arrival and departure dates. A late arrival or early departure at the Customer's initiative does not automatically entitle them to a reduction or refund. The applicable times are those stated on the offer page, in the confirmation or by the accommodation provider concerned. The Customer must notify the service provider of a late arrival when requested to do so.

12. No general right of withdrawal

Swiss law does not provide a general right of withdrawal for every order placed online. Unless a different mandatory statutory provision applies or a more favourable condition is expressly granted in the offer, the order is subject to the cancellation conditions set out in these Terms and the specific terms. Any mandatory protections applicable because of the nature of the contract or the Customer's circumstances remain unaffected.

13. Cancellation by the Customer

All cancellation requests must be sent to contact@breeziful.com. The date on which the written request is received determines the applicable scale of charges.

Unless different specific terms are clearly displayed before ordering:

  • more than 30 days before the service begins: cancellation charges amounting to 30% of the total price;
  • 30 days or less before the service begins: cancellation charges of up to 100% of the total price;
  • a special or promotional offer, or one stated to be non-refundable: charges of up to 100% of the total price.

The charges applied must take account of commitments already made, non-recoverable amounts, the terms accepted and the applicable mandatory rules.

14. Changes requested by the Customer

A change of dates, participants, name or service is subject to availability, the service provider's agreement, the applicable pricing conditions and any costs actually incurred. Breeziful does not guarantee that a change can be accepted. Before any change involving a charge, the Customer must be informed of the additional amount.

15. Transfer of the booking

Where a service is transferable, the Customer may request its transfer to a person who meets the same conditions. The request must be made as soon as possible and, where applicable, at least seven days before the service begins. The transfer remains subject to the service provider's agreement, whether or not the service is tied to a named person, the necessary formalities and the costs actually incurred.

16. Changes or cancellation by Breeziful or the service provider

In the event of a significant change before the service begins, Breeziful informs the Customer as soon as possible. Depending on the circumstances, the Customer may be offered the option of accepting the change, a replacement service, a credit voucher accepted voluntarily, or a refund of the amounts corresponding to the service not provided. A credit voucher must not be imposed when a refund is legally due.

17. Travel formalities

The Customer is responsible for checking the formalities applicable to their own circumstances and those of the other travellers, including passports, identity cards, visas, travel authorisations, health formalities, vaccinations, entry and transit requirements and authorisations relating to minors. This information may vary according to nationality, country of residence, destination, transit country and travel date. The Customer must consult the relevant official sources.

18. Transport

Transport is included only when expressly mentioned in the offer and confirmation. Where the Customer arranges their own transport, they are responsible for allowing for timings compatible with the service booked. The carrier's terms apply to the services it provides.

19. Accommodation, activities and local rules

The Customer must comply with the establishment's rules, safety instructions, communicated schedules, occupancy rules, stated restrictions and local laws and customs. A guarantee or security deposit may be required when mentioned in the offer or the establishment's terms. The Customer is responsible for damage caused by themselves or by the people benefiting from their booking.

20. Personal belongings

The Customer remains responsible for their personal belongings. They are encouraged to use the security facilities provided and not to leave valuables unattended. The liability of Breeziful or the service provider in the event of loss, theft or damage is determined according to the circumstances and the applicable statutory provisions.

21. Insurance

Unless otherwise stated, no travel insurance is included in the price. The Customer is encouraged to check their cover and consider suitable insurance, particularly for cancellation, interruption of the stay, medical expenses, repatriation, baggage, personal liability and specific activities.

22. Complaints

In the event of a difficulty during the service, the Customer must, as far as possible:

  1. report the problem immediately to the service provider on site;
  2. allow the service provider to propose a solution;
  3. inform Breeziful if the problem is not resolved;
  4. keep relevant supporting evidence.

A written complaint may be sent to contact@breeziful.com. It must specify the order number, the service concerned, the facts, the steps already taken, the solution requested and the supporting evidence available.

23. Liability

Breeziful is accountable for its own contractual obligations within the limits set by the contract and applicable law. Where the service is performed by a third party, the allocation of liability depends in particular on the role stated for Breeziful, the nature of the contract, the service concerned, the applicable statutory obligations and the facts giving rise to the damage.

The service provider remains responsible for the operational delivery incumbent upon it, but this responsibility does not automatically remove any contractual obligations Breeziful may have towards the Customer. No clause in these Terms limits any liability that cannot legally be excluded or limited.

24. Force majeure and extraordinary circumstances

A party may be prevented from performing all or part of its obligations by an event that is unforeseeable, unavoidable or beyond its control. The affected obligations may be suspended, adjusted or cancelled depending on the nature of the event. The financial consequences are determined according to the services actually provided, recoverable amounts, non-recoverable costs, the service provider's terms and mandatory statutory provisions.

25. Personal data

The data required for the order is processed in accordance with the Breeziful Privacy Policy. The necessary data may be shared with the provider responsible for delivering the service.

26. Governing law and dispute resolution

These Terms are governed by Swiss law, subject to any mandatory provisions applicable to the Customer. In the event of a difficulty, the Customer is encouraged to contact Breeziful to seek an amicable solution at contact@breeziful.com. If no amicable solution is reached, the competent court is determined in accordance with the applicable legal rules.

27. Changes to the Terms

Massard-Guersan & Cie SNC may amend these Terms for future orders. The version applicable to an order remains the one accepted when it was concluded. A subsequent amendment does not retroactively change the terms of an order already concluded, unless the parties agree otherwise or a statutory provision provides otherwise.
